Through its advanced broadband mapping technology, Connected Nation has been at the forefront of a national movement by state and local leaders to identify and map areas with and without broadband service and to identify and implement aggressive demand-stimulation programs that are designed to increase broadband adoption and encourage network deployment. Connected Nation is available to work with any state, region or federal body in an effort to measure and map the availability and use of broadband. UPDATE: Request for Proposal, November 17, 2009 RFP Broadband GIS Data Processing UPDATE: November 20, 2009: UPDATE: RFP Clarification, November 25, 2009 UPDATE: RFP Clarification, December 1, 2009 In regard to Vendor Contract, Section 13 “Force Majeure”, CN makes the following changes to the language: Vendor will not be held responsible for delay, default or penalty caused by failure by Client to provide source materials identified in the work packets according to the agreed upon schedule and condition, fire, riot, acts of God, or war if the event is beyond Vendor’s reasonable control and the Vendor gives notice to the Client immediately upon occurrence of the event causing the delay or default or which is reasonably expected to cause a delay or default. The burden of proof for the need of such relief from performance of the contract shall rest upon the Vendor. In regard to Vendor Contract, Section 20 “Non-Compete”, CN makes the following changes to the language: Vendor recognizes and acknowledges that by virtue of accepting the terms of this Contract, Vendor will acquire valuable knowledge, skills and experience, and learn proprietary and in some cases confidential information of Client. Therefore, Vendor shall not engage any persons, firms, Client employees, Client third-party contractors or any other persons or entities with broadband mapping programs directly or indirectly funded or anticipated to be funded by federal dollars for a period of three (3) years after the conclusion or termination of this Contract, whichever comes first. Any broadband mapping programs existing as of the effective date of this contract, as demonstrated by Vendor as a part of Vendor’s RFP response and approved in CN’s sole discretion, shall be exempt from this provision. All Vendors who believe any prior federally funded or anticipated to be federally funded broadband mapping projects fit within this exclusion, shall be required to provide a specific list of those projects to CN by the Phase II Proposal deadline set forth in the RFP. Late submissions or additions/revisions to this list after the Phase II response date will not be accepted.
